Key Principle

In a libel claim a defendant may make out the s.2 Defamation Act 2013 truth defence to a 'fraudster' imputation by reference to historic dishonest conduct where the claimant's continued lack of remorse shows that her character is unchanged, and a successful truth defence defeats the claim notwithstanding that serious harm under s.1 is established.
