Key Principle
There is no presumption of undue influence in the case of a will (unlike a lifetime gift); whether a will was procured by undue influence is a question of fact for the person alleging it, but it may be established by inference from circumstantial evidence where the cumulative facts are inconsistent with any other explanation.
