A person who was not a party to earlier proceedings, and who was not joined although the claimants could have joined him, is not bound by the judgment in those proceedings through res judicata or issue estoppel; fairness requires that a party be joined before being bound, and mere knowledge of, or an interest in, the prior litigation is insufficient.
