Key Principle

A debarring order is a draconian sanction of last resort, to be imposed only where a party's conduct jeopardises the fairness of the trial or amounts to an abuse preventing justice; where non-compliance is serious but does not justify debarring, the court may instead order security for costs under CPR 3.1(5) as a proportionate alternative condition of continued participation.
