Key Principle

The repetition rule applies with no less vigour to a level 1 (conduct) plea of justification than to a level 2 (reasonable grounds to suspect) plea, so a defendant cannot justify a defamatory allegation by relying on the existence of an investigation or report rather than proving the underlying conduct.
