Key Principle

In judicial review proceedings, where there is a conflict on the evidence the facts stated in the respondent's witness evidence are generally to be accepted unless the applicant has applied to cross-examine the witness or the evidence cannot be correct; a party who wishes to challenge the accuracy of the respondent's factual account should apply to cross-examine rather than invite the court to make adverse findings on the papers.
