Sompo Japan Insurance Inc v Transfercom Ltd

On an application to sanction an insurance/reinsurance business transfer scheme under Part VII of the Financial Services and Markets Act 2000, the court must be satisfied on the evidence (notably the independent expert's report and the regulator's views) that the scheme is fair as between affected policyholders and shareholders and adequately protects the security and reasonable expectations of transferring policyholders.
