State Bank of India v Mallya

[2019] EWHC 995 (QB)
JurisdictionUnited Kingdom
CourtHigh Court of Justice (Queen's Bench Division)
Year2019
StatusPersuasive authority

Key Principle

On an application to make final a third party debt order in aid of enforcing a registered foreign judgment, the judgment creditor's failure to disclose a pending bankruptcy petition and a worldwide freezing order at the interim stage is not necessarily fatal where there are strong grounds for the order; such matters fall to be considered on further consideration of the order, not the interim stage.
