Key Principle

Where a lessee defaults under an early-termination agreement reached after lease default, the lessor may revert to and enforce the original lease's stricter redelivery/restoration obligations, and may obtain summary judgment for unpaid rent, repossession costs and restoration expenses notwithstanding earlier acceptance certificates as to the aircraft's redelivery condition.
