An imaging (preservation) order against a departing employee suspected of misappropriating confidential documents will be upheld at the return hearing where there is a strong prima facie case, evidence of serious potential damage, clear proof of possession of incriminating material and proportionality; but the claimant is not entitled to direct access to the imaged material, which must be reviewed through the defendant's solicitors using agreed search terms.
