Verum Plus AG (in liquidation) & Ors v Petroineos Trading Limited

An assignment of the right to conduct litigation made under Article 260 of the Swiss Debt Enforcement and Bankruptcy Act is ineffective against a contractual counterparty where the underlying contract contains a valid prohibition on assignment, but such a clause does not bar pursuit of related claims (e.g. an oral joint venture agreement) that contain no anti-assignment provision.
