Key Principle

A claim may be struck out under CPR 3.4(2)(b) and (c) where inordinate, inexcusable delay and a sustained failure to comply with court orders amount to an abuse of process and so seriously impair the prospect of a fair trial, even where the defendant bears some responsibility for the delay, if the claimant's default is of a wholly different order.
