Whitney v. California

Key Principle
A State may, consistent with the First Amendment, punish advocacy that tends to incite crime, disturb the public peace, or threaten the overthrow of organised government; but free political speech is essential to democracy and may be restrained only where the danger of serious evil is imminent (Brandeis, J., concurring).
