Key Principle

Where a Severe Disability Premium becomes payable because of a relevant change of circumstances rather than because the claimant 'subsequently became in receipt of a relevant benefit', the more generous backdating rule does not apply, and the resulting differential treatment does not engage an 'other status' for the purposes of Article 14 ECHR.
