bid protestjudicial estoppel
Corp. v. Johnson
78 F.3d 1556 (Fed. Cir. 1996)
Key Principle
In a government procurement protest a disappointed bidder must show not only a significant error in the procurement process but also that the error prejudiced it; judicial estoppel will not preclude the agency from a litigating position absent identity of parties and issues with the earlier proceeding.
