Key Principle

To invoke the admiralty in rem jurisdiction of the High Court under the High Court (Admiralty Jurisdiction) Act the claimant must bring its claim within one of the statutory heads in s 3(1) and satisfy the connecting requirements; an applicant for a warrant of arrest owes a duty of full and frank disclosure, breach of which (together with the absence of a reasonable cause of action) may found liability for wrongful arrest.
