Key Principle
A prenuptial agreement is not contrary to public policy and may be given significant weight in the division of matrimonial assets, but it is only one factor and not determinative, because the court retains the ultimate statutory power under s 112 of the Women's Charter to divide assets in such proportions as it considers just and equitable.
