In a felon-in-possession prosecution under 18 U.S.C. §922(g), Judge Mizelle's opinion reasoned that, under the Supreme Court's Commerce Clause precedents (Lopez and Morrison), the statute's reliance on Scarborough's minimal interstate-commerce nexus is in serious tension with, and arguably exceeds, Congress's power to regulate interstate commerce.
